Part I: Privacy Agreement

1. Introduction

Welcome to the Platform ("we" or "us" or "the Platform"). We are committed to protecting the security of your personal information and that of your children. Please read this Privacy Agreement carefully to understand how we collect, use, store and protect your information. This Agreement applies to users in China, France, Japan, and Singapore, and is especially intended for young people between the ages of 4 and 16 and their guardians.

2. Information we collect

2.1 Basic registration information

  • Adult users: username, real name (optional), email address, mobile phone number, age, gender, nationality/region.
  • Users who are minors: guardians are required to provide necessary information such as guardian's name and contact information (original files are not stored).
  • Other: additional information such as interest tags, artistic preferences, etc. that the user chooses to fill in.

2.2 Creative and social information

  • Uploaded content: paintings, text, photography, AI creation results and other original content, as well as comments and news.
  • Interaction data: Likes, comments, sharing records, group/private message exchanges (for anti-spam and security audit only).

2.3 Device and Behavioural Data

  • Device information: IP address, device model, operating system, browser type, login location (for security and service optimisation only).
  • Usage history: login time, browsing history, frequency of function usage (e.g. course learning progress, tournament participation record).

2.4 Special scenario information

  • Art healing function: users voluntarily fill in the emotional state, psychological feedback questionnaire (only for personalised content recommendation, not associated with other services).
  • Parental control: usage time limit, consumption limit, content filtering rules and operation logs set by guardians.

2.5 Restrictions on sensitive information

  • We do not actively collect sensitive personal information such as biometrics, medical health, religious beliefs, etc. of minors unless mandated by law or expressly authorised by a guardian.

3. Purpose of use of information

  • Core service functionsThe company provides platform services such as art socialisation, course learning, tournament matchmaking, and NFT digital assetisation.
  • Personalised recommendations: Analyse user behaviour data to recommend art content, events or partner organisations (personalised recommendations can be turned off at any time).
  • Security and Compliance: To guard against fraudulent, tortious or illegal activities and to cooperate with judicial investigations.
  • Operations Optimisation: Improve the functionality of the platform and conduct user research or satisfaction surveys (with optional user participation).
  • legal obligation: Comply with data security and privacy protection regulations in each jurisdiction.

4. Information sharing, transfer and disclosure

4.1 Shared principles

  • Refuse to share illegally: We do not sell or rent users' personal information to third parties.
  • Creative Commons: Share information only in the following circumstances and ensure that the recipient signs a confidentiality agreement:
    • service provider: Third parties, such as server hosting, payment and settlement, technical support, etc., are only used in scenarios necessary for the operation of the platform.
    • cooperative partnerIf the user is a member of an organisation such as an art school or an event organiser, the information will only be shared when the user actively participates in the event (prior consent of the user/guardian must be obtained).
    • Legal requirements: Provide the necessary information in response to a court judgement, an administrative penalty or an investigation by a national security agency.

4.2 Cross-border data transfer

  • If the user is located in the EU, Japan, Singapore, etc., we promise:
    • Data is stored on locally compliant servers (if servers in the EU meet GDPR requirements).
    • When transmitting data outside of the country, data transfer compliance is ensured through Standard Contractual Clauses (SCCs) or by obtaining individual authorisation from the user/guardian.

5. Protection of minors' privacy

5.1 Guardianship

  • Registration Verification: Users under the age of 16 will need a guardian to complete a secondary verification via email/mobile phone number when registering.
  • Parental Controls::
    • View your child's login history and postings in real time.
    • Set consumption limits.
    • Block sensitive keywords or restrict access to specific features.

5.2 Restrictions on the use of information

  • Minors' information will not be used for marketing promotions or personalised advertisements without the written consent of the guardian (except for exceptions permitted by law).
  • Content posted by minors hides sensitive information such as addresses and school names by default.

6. Information security and storage

6.1 Security measures

  • Technical level: SSL encrypted transmission, data desensitisation, regular vulnerability scanning to prevent data leakage.
  • Management level: Employees are required to sign confidentiality agreements and regular privacy compliance training is conducted.
  • Emergency Response: A contingency plan for data security incidents is in place, and in the event of a breach, affected users and regulators (e.g. GDPR requirements) will be notified within 72 hours.

6.2 Storage period

  • Adult Users: Deletion of their personal information after account cancellation (except as otherwise provided by laws and regulations).
  • Minor Users: Delete minor information immediately upon account cancellation or guardian's request for deletion, unless it is required to be retained to fulfil a legal obligation (e.g. tax records).

7. Rights of user data subjects

7.1 Core rights (for global users)

  • The right to withdraw consent

7.2 Exclusive rights of minors

  • The guardian may exercise all of the above rights in place of the minor and may request the platform to remove the minor's information at any time.

8. Cookies and similar technologies

8.1 Purpose of use

  • Analyse user behaviour to optimise the experience (e.g. counting page views).
  • Remember user preferences (e.g. language settings, night mode).
  • Used for security authentication (e.g. to prevent cross-site request forgery).

8.2 User Options

  • The cookie statement pops up on first visit and users can choose to accept all, reject non-essential cookies, or customise their settings.
  • Rejecting non-essential cookies does not affect the use of core functionality (e.g., registration, posting content).

9. Notifications and amendments

9.1 Protocol updates

  • If the privacy policy is adjusted, users will be notified at least 30 days in advance through the platform announcement, the letter or email.
  • Significant changes (e.g., expansion of the purpose of using the information) require the consent of the user/guardian.

9.2 Entry into force rules

  • The revised agreement is effective from the date of public announcement, and the user's continued use of the service is deemed to be acceptance of the new terms.

Part II: Website Terms of Use (Privacy Related Supplement)

1. User eligibility and responsibilities

  • The use of the Platform by minors requires full supervision by their guardians, who shall ensure that the minors comply with this Agreement and the Platform's rules.
  • If a user/guardian discovers that an account has been registered by a minor without authorisation, he/she may immediately contact the Platform to freeze the account and apply for cancellation.

2. Intellectual property and data licences

  • Original content uploaded by Users is by default licensed to the Platform for non-exclusive worldwide use for Platform display, promotion and compliance audits (e.g. NFT casting).
  • The platform promises that it will not use user data to train external AI models unless individually authorised by the user.

3. Exemptions and limitations of liability

  • The platform is not responsible for the authenticity of the information posted by users, and users need to judge the risk of the content by themselves.
  • The Platform shall not be responsible for any privacy breach caused by the user's disclosure of account passwords or violation of this Agreement.

4. Dispute resolution

  • jurisdiction::
    • Chinese users: Chinese law applies and disputes are submitted to the jurisdiction of the court where the platform operates.
    • Users in the European Union: have the option of filing a lawsuit in the courts of the platform's domicile or in the courts of its member states.
    • Users in other areas: Priority will be given to resolving the issue through negotiation, failing which it will be dealt with in accordance with the applicable laws of this Agreement.

 

Part III: NFT Licence Terms for Digital Image Works (Privacy Related Content)

  • Data use: When casting NFTs, only metadata about the work (e.g., title, time of creation) and information associated with the user's account are collected, and no additional personal information is involved.
  • Privacy: NFT transaction records are displayed anonymously by default, and users can choose to disclose their real name or keep a pseudonym.
  • earnings distributionNFT: The rules for distributing NFT proceeds will be agreed upon separately and the platform undertakes not to disclose user proceeds data unless required to do so by law.

 

special announcementThis Agreement takes into account the privacy requirements of different jurisdictions (e.g., the lawful basis of the GDPR, the informed consent principle of the PDPA). In the event of a conflict with local law, local law will prevail and the remaining terms will not be affected.

3. Purpose of use of information

  • Provide, maintain and optimise platform services.
  • Promote community communication and interaction.
  • Analyse user preferences and recommend personalised content and tasks.
  • Ensure that the platform is secure against abuse and fraud.
  • Compliance requirements and legal obligations.

4. Information sharing and disclosure

  • Does not sell or rent users' personal information to unauthorised third parties.
  • Information may be shared under the following circumstances:
    • With the consent of the user or guardian.
    • Requirements of laws and regulations.
    • Co-operate with service providers to support the operation of the Platform, and providers are subject to confidentiality obligations.
  • For third-party advertising or analytics services that involve the collection of user information, user consent is required.

5. Protection of children's privacy

  • This platform is intended for minors and strictly complies with the relevant national legislation on the protection of children's privacy.
  • Any user under the age of 16 must obtain the consent of a guardian to register.
  • Parents can view and control their child's information and account privileges through the Parent Management feature.
  • No child-sensitive information is actively collected and data is only used to fulfil the functionality of the platform.

6. Information security

  • Adopt reasonable technical and management measures to protect data security and prevent data leakage, loss and tampering.
  • Platform data storage meets local regulatory requirements.

7. User rights

  • Users and their guardians have the right to access, correct, and delete personal information.
  • Consent may be withdrawn at any time, but may affect the use of some of the Platform's features.
  • Users may exercise these rights by contacting us.

8. Cookies and tracking technology

  • To enhance the experience, we use cookies and similar technologies within reason.
  • Users can manage cookies through their browser settings.

9. International data transfer

  • The Platform may transmit data to servers outside of the country, but will take reasonable security measures to protect the information.
