Art Teen Social Platform User Privacy Agreement and Website Terms of Use

Part I: Privacy Agreement

1. Introduction

Welcome to the Platform ("we" or "us" or "the Platform"). We are committed to protecting the security of your personal information and that of your children. Please read this Privacy Agreement carefully to understand how we collect, use, store and protect your information. This Agreement applies to users in China, France, Japan, and Singapore, and is especially intended for young people between the ages of 4 and 16 and their guardians.

2. Information we collect

  • Registration Information: Username, age group, gender, contact information (e.g. email), etc.
  • Creative content: Uploaded paintings, text, comments, etc.
  • User behaviour data: Login time, browsing history, interactive behaviour (likes, comments, shares).
  • Equipment Information: IP address, device model, operating system, browser type.
  • Emotional feedback: The user's self-filled emotional state during the drawing healing process (voluntary by the user).
  • Parental Monitoring Information: Permissions set by parents for supervised users and records of access behaviour.

3. Purpose of use of information

  • Provide, maintain and optimise platform services.
  • Promote community communication and interaction.
  • Analyse user preferences and recommend personalised content and tasks.
  • Ensure that the platform is secure against abuse and fraud.
  • Compliance requirements and legal obligations.

4. Information sharing and disclosure

  • Does not sell or rent users' personal information to unauthorised third parties.
  • Information may be shared under the following circumstances:
    • With the consent of the user or guardian.
    • Requirements of laws and regulations.
    • Co-operate with service providers to support the operation of the Platform, and providers are subject to confidentiality obligations.
  • For third-party advertising or analytics services that involve the collection of user information, user consent is required.

5. Protection of children's privacy

  • This platform is intended for minors and strictly complies with the relevant national legislation on the protection of children's privacy.
  • Any user under the age of 16 must obtain the consent of a guardian to register.
  • Parents can view and control their child's information and account privileges through the Parent Management feature.
  • No child-sensitive information is actively collected and data is only used to fulfil the functionality of the platform.

6. Information security

  • Adopt reasonable technical and management measures to protect data security and prevent data leakage, loss and tampering.
  • Platform data storage meets local regulatory requirements.

7. User rights

  • Users and their guardians have the right to access, correct, and delete personal information.
  • Consent may be withdrawn at any time, but may affect the use of some of the Platform's features.
  • Users may exercise these rights by contacting us.

8. Cookies and tracking technology

  • To enhance the experience, we use cookies and similar technologies within reason.
  • Users can manage cookies through their browser settings.

9. International data transfer

  • The Platform may transmit data to servers outside of the country, but will take reasonable security measures to protect the information.

Part II: Website Terms of Use

1. User eligibility

  • The user must be a young person between the ages of 4 and 16 years old, and a guardian's consent is required for users under the age of 16.
  • By using the Platform, you agree to comply with these Terms and Conditions and related regulations.

2. User behavioural norms

  • Posting of illegal, inappropriate, infringing, violent, pornographic and other inappropriate content is prohibited.
  • Respect the privacy and rights of others and refrain from malicious harassment and bullying.
  • Obey community rules and express your views rationally.

3. Intellectual property rights

  • The user uploads the work and grants the platform a licence to use it for display and promotion.
  • The copyright of the work belongs to the user and the platform undertakes not to transfer or sell it without permission.

4. Account security

  • Users are responsible for the safekeeping of account information.
  • The Platform should be notified promptly of any account anomalies.
  • The Platform reserves the right to suspend or terminate the accounts of users who violate the Terms.

5. Disclaimer

  • Whilst every effort is made to ensure that the platform is secure and stable, the service is not guaranteed to be uninterrupted or error free.
  • The Platform is not responsible for the behaviour of Users or the content posted by Users.

6. Dispute resolution

  • The Platform applies Chinese law or the law of the user's location in accordance with the law.
  • Disputes will be resolved through friendly negotiation as a matter of priority, and if the negotiation fails, it will be submitted to the court of competent jurisdiction where the platform is located.

Website Terms of Use Supplement - NFT Licence for Digital Images

NFT Licensing Instructions for Digital Image Works

1. Purpose of the mandate

In order to support the diversified display and innovation of young people's artistic creations, the platform reserves the right to digitally assetise the digital image works uploaded by users (including paintings, digital art, etc.), including, but not limited to, making the works into non-homogenous tokens (NFTs) to be used in digital collections, sales, displays and community activities.

2. Scope of the mandate

  • Digital image works uploaded by Users on the Platform are, by default, authorised for the Platform and its partners to have the right to produce NFTs globally.
  • The authorisation includes, but is not limited to, the right to reproduce, display, distribute, transfer, sell, advertise and promote the rights of use and operation related to NFT.
  • The licence is non-exclusive and the user retains the copyright and all other rights to the work.

3. User rights and guarantees

  • During the production of NFT, the platform will respect the user's right of attribution by identifying the original author.
  • Users may contact the Platform at any time for information on the NFT status of their work and related information.
  • The Platform undertakes not to alter the content of the work or use it inappropriately without the user's consent.
  • If the User does not agree with the authorisation, the User may apply for withdrawal of the NFT authorisation via the Platform's contact details and the Platform will endeavour to co-operate with the process.

4. Distribution of proceeds

  • If the work NFT generates revenue, the platform will reasonably distribute the revenue to the users according to the subsequent specific rules.
  • The specific revenue mechanism will be separately explained through the platform announcement or user agreement to protect the legitimate rights and interests of users.

5. Legal liability

  • The user guarantees that the uploaded work is original or has been legally authorised and does not infringe the rights of any third party.
  • The user shall be liable for the actions within the scope of this authorisation.
  • The Platform is not responsible for copyright disputes arising from works uploaded by users.

Amendment and entry into force

These Supplemental Terms are an integral part of the User Privacy Agreement and the Website Terms of Use and are effective as of the date of publication. The User's continued use of the Platform Services constitutes acceptance of these Terms.
